1. INTRODUCTION
Mandacate Pty Ltd (“Mandacate”, “we”, “our”, or “the Platform”) requires all registered real estate agencies (“Agencies”) to comply with all applicable POPIA and FICA legislation when using the Mandacate Platform. This Agency POPI & FICA Declaration forms part of the mandatory compliance obligations for Agencies registering on the Platform.
By registering, the Agency confirms that it has read, understood, and agrees to this Declaration.
2. POPIA (PROTECTION OF PERSONAL INFORMATION ACT) DECLARATION
2.1 Lawful Processing
The Agency understands that Mandacate processes personal information solely for the purpose of facilitating digital property mandates and connecting Sellers with registered Agencies.
2.2 Consent to Data Use
The Agency grants Mandacate permission to:
- Store, verify, and process its company and principal information;
- Display its agency name and logo within the Mandacate geo-radius system;
- Share agency contact details with Sellers when allocating mandates.
2.3 Data Security
The Agency accepts responsibility for maintaining the confidentiality and security of its login credentials and all information submitted to the Platform.
2.4 Accuracy of Information
The Agency confirms that all information submitted is accurate, up-to-date, and lawfully obtained.
2.5 No Unauthorised Disclosure
The Agency agrees not to disclose confidential information obtained through Mandacate, including information relating to Sellers, other Agencies, or Mandacate operations.
2.6 POPIA Compliance
The Agency confirms that it operates in compliance with POPIA and has implemented appropriate internal safeguards to protect personal information.
2.7 Right of Access
Mandacate may request updated agency or principal details at any time to maintain POPIA compliance.
3. FICA (FINANCIAL INTELLIGENCE CENTRE ACT) DECLARATION
3.1 FICA Registration
The Agency confirms it is registered with the PPRA and complies with all FICA obligations that apply to real estate practitioners.
3.2 Verification Responsibilities
The Agency acknowledges that it is solely responsible for:
- Verifying the identity of buyers and sellers;
- Maintaining and storing FICA documentation;
- Ensuring all property transactions comply with FICA legislation.
3.3 Mandacate’s Role
Mandacate (Pty) Ltd does not conduct FICA verification and is not a party to any sale agreement. All FICA duties rest entirely with the Agency.
3.4 Record Keeping
The Agency must retain all FICA documents for the legally prescribed period and provide such documentation to authorities when required.
3.5 Reporting Suspicious Activity
The Agency acknowledges its legal obligation to report any suspicious or unusual transactions to the Financial Intelligence Centre.
4. DECLARATION & SIGNATURE
By submitting registration on the Mandacate Platform, the Agency confirms that:
- The information provided is true, accurate, and complete;
- The Agency adheres fully to POPIA and FICA requirements;
- The Agency accepts that failure to comply may result in suspension or removal from the Platform.
The Agency hereby acknowledges and agrees to the terms of this POPI & FICA Compliance Declaration.
